Senior Advocate of Nigeria, Dr. Olisa Agbakoba has filed a claim against the Federal Government of Nigeria to determine whether or not, the president of Nigeria can at the same time, hold another executive office as minister of petroleum resources.
 
Dr. Agbakoba, who is a former president of the Nigerian Bar Association, argues that on the basis of section 138 of the constitution, which disqualifies the president of Nigeria from taking any other paid employment, the president cannot hold office as minister of petroleum resources.
 
He urged the court to hold that the president is not validly qualified to be minister since his appointment was not confirmed by the senate as provided for by the constitution.
