The Chairman, Presidential Advisory Committee Against Corruption Professor Itse Sagay (SAN) said no law stops President Muhammadu Buhari from re-appointing Magu as EFCC's acting or sending his name again to the senate for confirmation.
According to him, it is possible that some senators are not comfortable with Magu due to his enthusiastic crusade against corruption.
Professor Sagay said since the senate only has a constitutional role to confirm and not to appoint, the person who has the right to appoint can do so again.
In the same vein, a human right lawyer, Femi Falana says President Muhammadu Buhari can still re-present Ibrahim Magu as the chairman of the Economic and Financial Crimes Commission.
Femi Falana said the president may in the alternative chose to allow him to remain in acting capacity pursuant to section 171 of the constitution.
The lawyer described senate’s rejection of Magu as chairman of the EFCC on the basis of a security report compiled by the State Security Service, as the height of official ridicule of the office of the president.
